The following general conditions apply to all orders placed by a customer concerning all products offered for sale on “ www.mybetterway.fr ”.

Clause 1: Purpose

The general conditions of sale described below detail the rights and obligations of the company My Better Way and its customer in the context of the sale of goods offered on the site www.mybetterway.fr .

The customer acknowledges having read these general conditions of sale and declares to accept them without reservation.

Clause 2: Price

The prices of products sold through the website are indicated in Euros, all taxes included, and precisely determined on the Product description pages, as well as on the product order page, and excluding specific shipping costs. The Company reserves the right to modify its prices at any time for the future. However, it undertakes to invoice the goods ordered at the prices indicated when the order is registered. The telecommunications costs necessary for access to the Company's websites are the responsibility of the Customer. If applicable also, delivery costs.

Clause 3: Payment terms

The sale price is payable in cash on the day of the actual order.

Payment for orders is made:

Clause 4: Delivery terms

The products are delivered worldwide, via different carriers, to the delivery address that was indicated when ordering and within the deadlines indicated, after receipt of your payment.

My Better Way declines all responsibility in the event of delay or lack of delivery due to an incorrect address.

The delivery time indicated when registering the order is given for information purposes only and is in no way guaranteed. Consequently, any reasonable delay in the delivery of the products cannot give rise to the benefit of the buyer:

• the award of damages;

• cancellation of the order.

When the Customer orders several products at the same time, they may have different delivery times; the products may then be transported separately, at no additional cost to the Buyer.

In the event of a stock shortage, we will notify you of additional lead times or product availability. A refund will be made if necessary.

The risk of transport is borne entirely by the buyer.
In the event of missing or damaged goods during transport, the buyer must make all necessary reservations on the order form upon receipt of said goods. These reservations must also be confirmed in writing within five days following delivery, either by registered mail or by email to mybetterwayfr@gmail.com.

Clause No. 5: Force majeure

The liability of the company My Better Way cannot be implemented if the non-execution or delay in the execution of one of its obligations described in these general conditions of sale results from a case of force majeure. . As such, force majeure means any external, unpredictable and irresistible event within the meaning of article 1148 of the Civil Code.

Clause no. 6: Withdrawal period

In accordance with the provisions of article L 221-5 of the Consumer Code, the Buyer has the right to withdraw without giving any reason, within fourteen (14) days from the date of receipt of his order. The right of withdrawal can be exercised by contacting the Company by email at julie@mybetterway.fr. If the right of withdrawal is exercised within the aforementioned period, the price of the product(s) purchased and the shipping costs will be refunded, the return costs remaining the responsibility of the Customer.

Product returns must be made in their original condition and complete (packaging, accessories, instructions) to the address My Better Way, 19 rue du Languedoc, 13129 Salin de Giraud.

Exercising the right of withdrawal gives rise to a refund of the sums paid when ordering as soon as possible and no later than 30 (thirty) days from the date on which you exercised this right.

Clause No. 7: Intellectual property rights

Any reproduction or total or partial representation of the Site or one of these rights, without the express authorization of My Better Way is strictly prohibited and would constitute an infringement punishable by the intellectual property code.​

The customer refrains from any action and any act likely to directly or indirectly infringe the intellectual property rights of My Better Way.

Clause No. 8: Competent court

Any dispute relating to the interpretation and execution of these general conditions of sale is subject to French law.

Failing an amicable resolution, the dispute will be brought before the Tarascon Commercial Court.
